New EU Clarifications on the Packaging Regulation

In March 2026, the European Commission published a Guidance document on the EU Packaging and Packaging Waste Regulation (PPWR, Regulation (EU) 2025/40). It provides, for the first time, concrete interpretations of key requirements and is therefore highly relevant for companies.

🔍 What qualifies as packaging?

According to the Commission, classification is purely function-based.
Identical items may be assessed differently depending on their use. In addition, Annex I of the PPWR is only indicative and not exhaustive.

🏭 Manufacturer vs. Producer

The Guidance clarifies:

  • The manufacturer is typically the brand owner or the entity defining the packaging specifications
  • The producer is the entity placing packaging on the market for the first time in a Member State

These roles may differ, particularly in international supply chains and e-commerce scenarios.

⚖️ Compliance requirements clarified

A key clarification concerns compliance obligations:

  • Manufacturers must carry out a conformity assessment procedure
  • A EU declaration of conformity is mandatory
  • Responsibility remains fully with the manufacturer

📦 Packaging minimisation

The Guidance provides initial clarification on the practical interpretation of packaging minimisation, particularly in relation to empty space requirements.

Conclusion

While the Guidance is not legally binding, it reflects the official interpretation of the European Commission and will significantly influence how the PPWR is implemented in practice.
