From 2024, the existing packaging regulation in the UK is to be revised and updated.

What will packaging EPR in Great Britain mean for the companies affected?

Extended Producer Responsibility (EPR) is a new piece of UK legislation whose implementation was last scheduled for 2024. It is a reform of the existing UK packaging waste regulations.

Obligated businesses should be aware of the following key points:

  • Producers will have a greater financial incentive to use packaging that is collected in bulk by households for recycling.
     
  • For reporting own quantities to the authorities, the previous de minimis limit of 2 million pounds to 1 million pounds turnover per year will be halved, as will the de minimis limit for packaging weight (previously 50 t p.a., then 25 t p.a.).
     
  • Additional data on the type of packaging and its recyclability must be collected and reported every six months. The first report is due by October 2023.
     
  • The data reporting requirements will become more complex.
     
  • The introduction of eco-modulation of EPR charges could increase compliance costs for producers if they use packaging that is difficult or difficult to recycle from 2025.
     
  • There will be a separate reporting requirement for packaging supplied by UK businesses.
     
  • From 1 April 2026, all packaging (with the exception of flexible films) will have to carry a binary recycling label stating either 'recycle' or 'do not recycle'.
